Terms and Conditions of Use

This Terms and Conditions (the “T&C) governs your access to and use of the Asian Pacific Society of Respirology (the “APSR”) website, except specific sections subject to individual terms.

  1. 1.Overview

    Your use of the website is expressly conditioned upon your accepting and agreeing to the T&C. By accessing, browsing or in any other way using the website, you accept, without limitations or qualification, the T&C.
    Your use of the website will be deemed to be acceptance of the T&C.

  2. 2.Changes to the Website and the Contents

    The APSR may, at any time, for any reason and without notice, make changes to (i) the website, including its look, feel, format (the Website), (ii) the contents including information, data, materials, products, the T&C and/or services as described on the Website (the “Contents).
    Any modifications will take effect when posted to the Website.

  3. 3.Disclaimer and No Warranty

    You assume all responsibility and risk associated with your use of the Website and the Contents. The Website and the Contents are provided “as is”, without warranty or representation of any kind, whether expressed, statutory or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement of any third-parties’ rights, all of which the APSR expressly disclaims to the fullest extent permitted by law.

    Under no circumstances whatsoever, including negligence and regardless of legal theory, shall the APSR, any of its officers, committee members, members, related entities, employees, representatives, other agents, or anyone else involved in creating or maintaining the Website, be liable for any damages whatsoever (including, without limitation, direct, indirect, incidental, special or consequential damages, or lost profits) that result from any of the following: (i) your use or inability to use the Website and/or any other websites that are linked to or from the Website, (ii) your reliance on any methods, products, recommendations, instructions, ideas, or other information obtained from the Website and/or any other websites that are referenced or linked to or from the Website, or (iii) mistakes, omissions, interruptions, deletion of files, viruses, errors, defects, or any failure of performance, communications failure, theft, destruction, or unauthorized access to the Website or contamination of your computer system or information.

    The APSR does not endorse and makes no warranty as to the accuracy, completeness, currency, availability, suitability, quality, or reliability of the Contents, and the APSR will not be liable or otherwise responsible for any failure or delay in updating the Contents. The APSR makes no representations or warranties that use of the Contents will be uninterrupted or error-free. In regions or countries that do not allow some or all of the above limitations of liability, liability shall be limited to the greatest extent allowed by law. This warranty disclaimer may be different in connection with specific products and services offered by the APSR.

    The Contents made available on the Website are protected by copyright, and their use is strictly prohibited except as outlined below. No Contents from the Website may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed without written permission from the rights owner, except for the Contents purposely made available by the APSR for downloading from the Website. If you use such Contents, you must (i) maintain all copyright and proprietary notices, (ii) use the information according to any associated licenses, (iii) refrain from copying or posting it on any networked computer or broadcasting it in any media, (iv) make no modifications to the information, and (v) refrain from making any additional representations or warranties about the information.

    Trademarks

    All rights in the trademarks, service marks, logos, trade names, and designs of the APSR or third parties, whether or not appearing in large print or with the trademark symbol, belong exclusively to the APSR or their respective owners and are protected under national and international trademark and copyright laws. Except as otherwise permitted on the Website, you are not permitted to reproduce, download or otherwise use such trademarks, service marks, logos, trade names, and designs without the prior express written consent of the owner of such mark.

    6.No Unlawful or Prohibited Use

    As a condition of your use of the Website, you warrant to the APSR that you will not use the Website for any purpose that is unlawful or prohibited by the T&C and related notices. You may not use the Website in any manner that could damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of the Website. You may not obtain or attempt to obtain any of the Contents through any means not intentionally made available or provided for through the Website.

    7.Spamming

    Gathering email addresses from the Website and the Contents through any method is prohibited. Posting or transmitting unauthorized or unsolicited advertising, promotional materials, or any other forms of solicitation to the other users is prohibited.

    8.Third-Party Website

    Solely for your convenience, we may provide links to various other websites that may be of interest to you and are for your convenience only. However, the APSR does not control or endorse these websites and is not responsible for their content, including the accuracy or reliability of such content. Please read the terms and conditions or terms of use policies of any other company or website you may link to from the Website. The T&C applies only to the Website of the APSR and its Contents. If you decide to access any of the third-party sites linked from the Website, you do so at your own risk. The APSR reserves the right to terminate any link. The APSR disclaims all warranties, expressed and implied, as to the accuracy, validity, and legality or otherwise of any materials or information contained on linked sites.

    9.No Professional Advice

    The Contents should not be used or relied on to obtain any medical information.
    The information available on the Website and in the Contents is intended to be a general information resource regarding the matters covered, and is not tailored to your specific circumstanced. You should not construe the Contents as medical or other professional advice. The Website and the Contents are not intended for use by minors.

    10.Separate Agreements

    You may have other agreements with the APSR. Those agreements are separate and in addition to the T&C. The T&C do not modify, revise or amend the terms of any other agreements you may have with the APSR.

    11.Governing Law, Location and Miscellaneous

    The T&C shall be governed in all respects by the laws of Japan, where the APSR Secretariat is located. If an applicable law is in conflict with any part of the T&C, the T&C will be deemed modified to conform to the law. The other provisions will not be affected by any such modification.

    12.For APSR Members only

    Password and Security

    You are not obligated to register with the APSR in order to access the Website. However, certain sections and features of the Website are available only to members who have registered for the APSR (the “Members”) and have user IDs and passwords (the “Account”). The Members agree to accurately maintain and update any information provided to the APSR. If the Members do not maintain such information, or if the APSR has reasonable grounds to suspect as much, the APSR has the right to suspend or terminate the Account and the Members’ use of the Website. The Members are responsible for all activities that occur under their Account. The Members must maintain the confidentiality of their password and restrict access to their computers to prevent unauthorized access to the Website. In the event a compromise of their account or password, the Members must notify the APSR immediately. The APSR reserves the right to take any necessary action to maintain the security of the Website and the Members’ Accounts, including terminating Accounts, changing passwords, or requesting information to authorise transactions.

    The Members may only have one active Account per Member on the Website at any given time, and they may use their designated account to access the Website. Members also agree to promptly notify the APSR of any unauthorized use of their registered name, password, ID, or any other breach of security involving or relating to the Website by emailing info@apsr.org.
    In addition, the Members agree to exit from their Account at the end of each session. The APSR explicitly disclaim liability for any and all losses and damages arising from the Members’ failure to comply with the T&C.

    Assembly Community

    The APSR provides an interactive messaging feature (the “Assembly Community”) to each APSR Assembly’s webpage for the Members who registered for the Assemblies (the “Assembly Members”).
    The Assembly Community is intended to serve as a communication tool between the Assembly Members.

    The Assembly Members acknowledge that they own, are solely responsible for or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate the T&C and will not cause injury to any person or entity; and that you will indemnify the APSR and their affiliates for all claims resulting from content you supply.

    You are solely responsible for your interactions with other users. The APSR Secretariat reserves the right, but has no obligation, to monitor disputes between you and other users. The Assembly Members failing to comply with the T&C may be expelled from and refused continued access to the Assembly Community in the future.

    The Assembly Members acknowledge and agree that the Assembly Community is public space and that their participation in the Assembly Community creates no expectation of privacy. Further, The Assembly Members acknowledge that any personal information they communicate in the Assembly Community may be seen and used by others. The APSR is not responsible for information that the Assembly Members choose to communicate in the Assembly Community, or for the Assembly Members’ actions or the actions of other users. The APSR or its designated agents may remove or alter any information or the Contents posted or otherwise disclosed in the Assembly Community at any time for any reason.

    IF THE ASSEMBLY MEMBERS CHOOSE TO MAKE ANY OF THEIR PERSONALLY IDENTIFIABLE OR OTHER INFORMATION PUBLICLY AVAILABLE IN THE ASSEMBLY COMMUNITY OR OTHERWISE ON OR THROUGH THE WEBSITES, THE ASSEMBLY MEMBERS DO SO AT THEIR OWN RISK.

    You are expressly prohibited from placing any message in the Assembly Community, any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racial, ethnic, or otherwise objectionable material of any kind.

    If you make any submission to the Assembly Community, you automatically represent and warrant that the owner of such content or intellectual property has expressly granted the APSR a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed.

    The APSR reserves the right (but is not obligated) to do any or all of the following:
    (i) Record the dialogue in the Assembly Community.
    (ii) Examine an allegation that a communication does not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication.
    (iii) Remove communications that are abusive, illegal, or disruptive, or that otherwise fail to conform with the T&C.
    (iv) Terminate the user’s access to the Assembly Community and/or the Website upon any breach of the T&C.
    (v) Monitor or disclose any communication in the Assembly Community.
    (vi) Edit or delete communications posted in the Assembly Community, regardless of whether such communication violates these standards.

    The APSR reserves the right to take any action it deems necessary to protect the personal safety of a user or the public. The APSR has no liability or responsibility to users or any other person or entity for performance or nonperformance of the aforementioned activities.
